Ética e compliance religioso: autonomia institucional e relação negocial no estado democrático de direito

| dc.description.abstract | O presente trabalho investiga a tensão estrutural entre a liberdade religiosa constitucionalmente assegurada e a exigência de accountability ética, transparência e responsabilidade institucional das organizações religiosas no ordenamento jurídico brasileiro. Partindo do dado de que o Brasil possui mais de 579 mil templos religiosos número superior à soma de escolas e postos de saúde, a pesquisa identifica um vácuo regulatório que, à margem da ampla autonomia eclesial, permite a ocorrência de práticas abusivas como a coação moral em doações, a naturalização da violência doméstica e o desvio de finalidade de recursos públicos, sem mecanismos adequados de responsabilização. A análise percorre a evolução histórico-constitucional da relação entre Estado e religião no Brasil, da confessionalidade excludente da Constituição de 1824 à laicidade cooperativa consagrada pela Constituição de 1988, que reconhece as organizações religiosas como pessoas jurídicas de direito privado dotadas de autonomia organizacional, sem, contudo, eximí-las dos princípios da dignidade da pessoa humana, da boa-fé objetiva e da legalidade. O referencial teórico articula as contribuições de Robert Alexy sobre a ponderação de direitos fundamentais, de Jürgen Habermas sobre a sociedade pós-secular e o papel público da religião, e dos filósofos Isaiah Berlin, Benjamin Constant e John Stuart Mill sobre os limites e dimensões da liberdade individual. A metodologia adotada é qualitativa e interdisciplinar, combinando análise doutrinária e jurisprudencial com pesquisa de campo realizada junto à Controladoria-Geral do Município de Londrina em 2025No plano crítico, o trabalho examina as violências de gênero no contexto evangélico conservador, demonstrando como interpretações da doutrina da submissão feminina podem naturalizar a violência doméstica e elevar o risco de feminicídio. Analisa ainda a instrumentalização da fé nos atos antidemocráticos de 8 de janeiro de 2023 e os limites de aplicação da Lei Anticorrupção às igrejas quando sua personalidade jurídica é utilizada para fins ilícitos. Diante desse diagnóstico, propõe-se o Compliance Religioso como mecanismo voluntário de autorregulação ética, fundamentado no Direito Negocial, capaz de conciliar a autonomia eclesial com os valores constitucionais da dignidade humana e da boa-fé. | dc.description.abstractother1 | This study investigates the structural tension between constitutionally guaranteed religious freedom and the demand for ethical accountability, transparency, and institutional responsibility of religious organizations within the Brazilian legal system. Starting from the fact that Brazil has more than 579,000 religious temples—a number greater than the combined total of schools and health clinics—the research identifies a regulatory gap that, on the margins of broad ecclesiastical autonomy, allows abusive practices such as moral coercion in donations, the normalization of domestic violence, and the diversion of public resources, without adequate accountability mechanisms.The analysis traces the historical-constitutional evolution of the relationship between State and religion in Brazil, from the exclusionary confessionalism of the 1824 Constitution to the cooperative secularism enshrined in the 1988 Constitution. The latter recognizes religious organizations as private legal entities endowed with organizational autonomy, while not exempting them from the principles of human dignity, objective good faith, and legality. The theoretical framework articulates the contributions of Robert Alexy on the balancing of fundamental rights, Jürgen Habermas on post-secular society and the public role of religion, and the philosophers Isaiah Berlin, Benjamin Constant, and John Stuart Mill on the limits and dimensions of individual liberty. The adopted methodology is qualitative and interdisciplinary, combining doctrinal and jurisprudential analysis with field research conducted at the Office of the Comptroller General of the Municipality of Londrina in 2025. This approach can fill the existing regulatory gap and reconcile religious freedom with the protection of human dignity and the sound management of public resources. On the critical level, the work examines gender-based violence in conservative evangelical contexts, demonstrating how interpretations of the doctrine of female submission can normalize domestic violence and increase the risk of femicide. It also analyzes the instrumentalization of faith in the anti-democratic acts of January 8, 2023, and the limits of applying the Anti-Corruption Law to churches when their legal personality is used for illicit purposes. In light of this diagnosis, Religious Compliance is proposed as a voluntary mechanism of ethical self-regulation, grounded in Contract Law, capable of reconciling ecclesiastical autonomy with the constitutional values of human dignity and good faith. The study concludes that Religious Compliance represents a proactive path to strengthening the institutional credibility of churches, protecting the faithful from abuses, and ensuring the integrity of the Democratic Rule of Law in a plural society | |
