dc.description.abstractA dissertação tem como tema a responsabilidade civil das plataformas digitais por conteúdos gerados por terceiros diante das transformações promovidas pelo recente entendimento do Supremo Tribunal Federal acerca do artigo 19 do Marco Civil da Internet, em diálogo com as experiências regulatórias da União Europeia e dos Estados Unidos e com os referenciais teóricos do liberalismo e do republicanismo. O objetivo consiste em investigar se é possível conciliar os ideais liberais de proteção da liberdade de expressão e limitação da intervenção estatal com a concepção republicana de liberdade como não dominação na construção de um regime de responsabilidade civil e de regulação das plataformas digitais capaz de assegurar segurança jurídica, autonomia privada, proteção dos direitos fundamentais e dos negócios jurídicos. Parte-se da hipótese de que nenhuma dessas tradições políticas, isoladamente considerada, oferece respostas suficientes aos desafios decorrentes da concentração de poder econômico e informacional das plataformas digitais, sendo necessária a aproximação entre as contribuições de John Stuart Mill e Philip Pettit para a formulação de um modelo regulatório equilibrado. Adota-se o método de abordagem indutivo, tomando como ponto de partida a análise do julgamento dos Recursos Extraordinários n.º 1.037.396 e n.º 1.057.258 pelo Supremo Tribunal Federal, utilizando-se, como métodos de trabalho, a pesquisa bibliográfica e jurisprudencial, fundamentada no exame da doutrina, da legislação nacional e estrangeira e das decisões judiciais pertinentes. A investigação examina a evolução do regime brasileiro de responsabilidade civil das plataformas digitais, os fundamentos político-filosóficos da liberdade de expressão, os modelos regulatórios adotados na União Europeia e nos Estados Unidos e os impactos da atuação das plataformas sobre a autonomia privada e a segurança jurídica dos negócios jurídicos. Ao final, conclui-se que a construção de um regime jurídico adequado para a responsabilidade civil das plataformas digitais demanda a harmonização entre os valores liberais e republicanos, de modo a compatibilizar a proteção da liberdade de expressão com a prevenção da dominação privada exercida pelas grandes plataformas, promovendo maior segurança para a realização de negócios jurídicos, tutela efetiva dos direitos fundamentais e fortalecimento do Estado Democrático de Direito
dc.description.abstractother1This dissertation examines the civil liability of digital platforms for third-party-generated content in light of the changes brought about by the Federal Supreme Court’s recent interpretation of Article 19 of the Brazilian Civil Rights Framework for the Internet, in dialogue with regulatory experiences in the European Union and the United States and with the theoretical frameworks of liberalism and republicanism. The objective is to investigate whether it is possible to reconcile the liberal ideals of protecting freedom of expression and limiting state intervention with the republican conception of freedom as freedom from domination in the construction of a regime of civil liability and regulation of digital platforms capable of ensuring legal certainty, private autonomy, and the protection of fundamental rights and legal transactions. The study begins with the hypothesis that none of these political traditions, considered in isolation, offers sufficient answers to the challenges arising from the concentration of economic and informational power in digital platforms; therefore, it is necessary to bring together the contributions of John Stuart Mill and Philip Pettit to formulate a balanced regulatory model. An inductive approach is adopted, taking as its starting point an analysis of the Federal Supreme Court’s rulings on Extraordinary Appeals Nos. 1,037,396 and 1,057,258, using, as working methods, literature and case law research, grounded in an examination of legal doctrine, domestic and foreign legislation, and relevant judicial decisions. The study examines the evolution of the Brazilian legal framework governing the civil liability of digital platforms, the political-philosophical foundations of freedom of expression, the regulatory models adopted in the European Union and the United States, and the impacts of the platforms’ operations on private autonomy and the legal certainty of legal transactions. In conclusion, it is determined that establishing an appropriate legal framework for the civil liability of digital platforms requires harmonizing liberal and republican values, so as to reconcile the protection of freedom of expression with the prevention of private domination exercised by large platforms, thereby promoting greater security for the conduct of legal transactions, effective protection of fundamental rights, and the strengthening of the democratic rule of law
