dc.description.abstractA intervenção do Estado sobre o domínio econômico apresenta contornos singulares em países em desenvolvimento e de “modernidade tardia”, a demandar uma relação de subordinação dirigida, essencialmente, à coordenação e harmonização da vida social e econômica (Lourival Vilanova, 2003). Sob tal aspecto, o Estado despoja-se da postura passiva e assume a missão de remover obstáculos ao bem-estar individual e coletivo. Dentre os direitos fundamentais que compõem esse cenário, destaca-se o direito à propriedade, e, nesta pesquisa, à propriedade imobiliária urbana, essencial para fomentar a inclusão econômica e viabilizar o usufruto das externalidades positivas do capitalismo contemporâneo. No Brasil, dados institucionais apontam que a irregularidade fundiária urbana são seculares e impedem transmutar o ativo representado pela propriedade em bem fungível, com fins de circular no domínio econômico em suas diversas formas, tais quais, dispor, gozar, reaver, constituir-se em crédito e figurar como garantia real. Tais possibilidades são identificadas nos estudos de Hernando de Soto (2001) na condição de “capital morto”, pois não compõe a “redoma de vidro”, metáfora para apontar o capital excluído do sistema legal de propriedade. No sistema de propriedade brasileiro, a irregularidade do ativo imobiliário, diante da ausência de representação formal, constitui um óbice legal com repercussões negativas não apenas individual quanto coletivamente, marco consolidado a partir do Código Civil (CC) de 1916. Conforme o art. 1º da Lei nº 8.935/94, o serviço registral integra a segurança jurídica, a garantir a publicidade, autenticidade e eficácia dos atos que envolvam o fólio real. Tais normas reforçam o princípio da inscrição nos termos do art. 1245 do CC de 2002, que exige um título registrado perante as serventias extrajudiciais, para culminar na eficácia plena dos arranjos negociais firmados. Apesar dessas normas, as expectativas de regularização das propriedades continuaram frustradas. Para enfrentar esta realidade há esforços do Estado brasileiro, através da atual Lei de Regularização Fundiária Urbana (REURB), nº 13.465/2017, com o escopo de regularizar núcleos urbanos informais e promover a função social da propriedade via títulos jurídicos registrados. Assim, também, novas oportunidades com a Lei 14.711/2023, que introduziu o Novo Marco Legal das Garantias e a formalização da Alienação Fiduciária da Propriedade Superveniente. Por meio desta intervenção normativa, é possível apontar incentivos, que são normas promocionais, aptas a gerar oportunidades de maximizar as utilidades do direito de propriedade em negócios jurídicos imobiliários. Neste contexto jurídico a figura do registrador é ressignificada, deixa de ser um anotador de títulos para tornar-se o guardião da fila de prioridades e da disponibilidade econômica dos imóveis, com o objetivo de potencializar a estabilidade das relações jurídicas negociais imobiliárias
dc.description.abstractother1State intervention in the economic domain displays unique contours in developing and “late modernity” countries, a reality that demands a relationship of directed subordination aimed, essentially, at the coordination and harmonization of social and economic life (Lourival Vilanova, 2003). Under this aspect, the State strips itself of a passive stance and assumes the mission to remove obstacles to individual and collective well-being. Among the fundamental rights that comprise this scenario, the right to property stands out, specifically urban real estate property in this research, which is essential to foster economic inclusion and to enable the enjoyment of the positive externalities of contemporary capitalism. In Brazil, institutional data indicate that urban land irregularity is secular and prevents the transmutation of the asset represented by property into a fungible good, with the purpose to circulate in the economic domain in its diverse forms, such as disposal, enjoyment, recovery, transformation into credit, and utilization as a real guarantee. Such possibilities are identified in the studies of Hernando de Soto (2001) as “dead capital,” because they do not compose the “bell jar,” a metaphor to point out the capital excluded from the legal property system. In the Brazilian property system, the irregularity of the real estate asset, in the absence of formal representation, constitutes a legal obstacle with negative repercussions both individually and collectively, a framework consolidated since the Civil Code (CC) of 1916. According to Article 1 of Law No. 8,935/94, the registry service integrates legal certainty, with the duty to guarantee the publicity, authenticity, and efficacy of acts that involve the real estate folio. Such rules reinforce the principle of registration under Article 1245 of the 2002 Civil Code, which requires a registered title before extrajudicial registries to culminate in the full efficacy of the business arrangements executed. Despite these rules, expectations for property regularization remained frustrated. To face this reality, there are efforts by the Brazilian State through the current Urban Land Regularization Law (REURB), No. 13,465/2017, with the scope to regularize informal urban settlements and to promote the social function of property via registered legal titles. Likewise, new opportunities arise with Law No. 14,711/2023, which introduced the New Legal Framework for Guarantees and the formalization of the Supervenient Fiduciary Alienation in Guarantee. Through this normative intervention, it is possible to point out incentives, which are promotional norms, capable to generate opportunities to maximize the utilities of the property right in real estate legal transactions. In this legal context, the figure of the registrar is redefined; the professional ceases to be a mere recorder of titles to become the guardian of the priority queue and of the economic availability of real estate, with the objective to enhance the stability of real estate transactional legal relations
