dc.description.abstractResumo: Uma das questões mais discutidas, no âmbito do Direito, é como os juízes decidem e como operam na construção do texto judiciário, em forma de decisão ou sentença Na atualidade, a produção desses textos jurídicos, muitas vezes, precisa ser compartilhada com uma equipe de assessores do gabinete dos juízes, que podem receber intervenções do julgador decorrentes da alteração da intelecção do caso ou, apenas, do aperfeiçoamento da utilização de recursos argumentativos ou estilísticos, sem alteração do resultado do julgamento Apesar de as teorias da decisão judicial buscarem expurgar a subjetividade do processo de construção da decisão judicial, ela é inevitável e transparece na linguagem Nesse contexto, o objetivo desta tese é estudar a forma como a Crítica Genética é capaz de dialogar com a Ciência Jurídica no processo de construção textual compartilhada de sentenças judiciais, e o modo como são integrados os aspectos interativo-discursivos dessa linguagem jurídica em todas as etapas, até o momento da versão final do juiz como signatário da decisão oficial O processo decisório judicial, concebido como movimento de construção textual jurídico, é examinado por meio de análise comparativa de versões das minutas desses textos Os aportes teórico-metodológicos são provenientes da Crítica Genética com base em Salles (1998; 2; 22; 24; 28; 216; 217a; e 217b), Panichi e Contani (23) e Panichi (216), da Semântica Argumentativa de Ducrot (1981; 22), e da Estilística por meio dos ensinamentos de Vilanova (1984), Lapa (1998), Martins (212), entre outros O corpus é constituído por sentenças, rascunhos e mensagens trocadas com assessores, referentes a casos concretos julgados pelo autor, magistrado de profissão, e por outros juízes federais As análises demonstraram semelhanças nas estratégias linguístico-argumentativas dos enunciadores-juízes, possibilitando um entendimento mais aprofundado dos mecanismos discursivos de que se utilizam, bem como dos elementos expressivos e impressivos do sistema intelectivo da língua, inerentes às linguagens humanas ordinárias, que escapam à linguagem referencial jurídicapt_BR
dc.description.abstractother1Abstract: One of the most widely debated issues in the field of Law is how judges make decisions and how they operate when constructing judicial texts, in the form of decisions or sentences Currently, the production of these judicial texts often needs to be shared with a clerks‘ team from the judge‘s chambers, who may receive input from the judge resulting from changes in intellection of the case or simply improvement on the usage of argumentative or stylistic resources without altering the outcome of the judgment Although theories of judicial decision-making seek to expurgate the subjectivity of the construction process of legal decisions, it is inevitable and apparent in language In this context, the aim of this thesis is to study the way in which Genetic Criticism is able to engage in a dialogue with Juridical Science in the process of shared textual construction of judicial sentences, and how the interactive-discursive aspects of this legal language are integrated at all stages, until the judge´s final version as a signatory to the official decision The judicial decision-making process, conceived as a movement of legal textual construction, is examined through comparative analysis of different drafts of such texts The theoretical-methodological foundation is derived from Genetic Criticism based on SALLES (1998; 2; 22; 24; 28; 216; 217a; e 217b) and PANICHI and CONTANI (23) and PANICHI (216), on the Argumentative Semantics of DUCROT (1981; 22), and on Style from the teachings of VILANOVA (1984), LAPA (1998), MARTINS (212) and others The corpus comprises sentences, drafts, and messages between clerks, relating to concrete cases judged by the author, a judge by profession, and by other federal judges Analyses showed similarities in the linguistic-argumentative strategies of enunciators-judges, enabling a deeper understanding of the discursive mechanisms used, as well as the expressive and impressive elements of the intellective system of the language, inherent to ordinary human languages, outside of legal languagept_BR
