| dc.description.abstract | Resumo: A preocupação com a água no mundo tem se tornado cada vez maior, considerando tratar-se de um recurso essencial à própria existência da vida A sociedade, em sua maior parte, utilizou e ainda utiliza-se dos recursos naturais sem o estabelecimento de limites seguros para a manutenção destes às gerações futuras Os problemas advindos deste uso indiscriminado dos recursos naturais foram diversos, inclusive guerras em vários locais ao redor do mundo, o que fez com que os países, organizações internacionais e a sociedade de modo geral buscassem instrumentos para a preservação do meio ambiente, a fim de garantir uma sadia qualidade de vida Assim, surge o conceito de desenvolvimento sustentável, com a prevalência de um desenvolvimento preocupado com as futuras gerações Diversos são os instrumentos existentes para a sustentabilidade, e dentre estes instrumentos, está a gestão compartilhada de recursos naturais O Acordo sobre o Aquífero Guarani surge como mecanismo de gestão compartilhada entre Brasil, Argentina, Paraguai e Uruguai, componentes do bloco econômico Mercosul, e como resultado de um tratado internacional que busca concessões recíprocas e objetivos comuns a serem atingidos Embora haja respeito à soberania de cada um dos países que realizam um acordo e aderem, voluntariamente, ao tratado, o propósito central é unificar regras de comportamento entre estes, os quais se mostram verdadeiros negócios jurídicos entre os Estados-parte, fazendo valer uma obrigação A presente pesquisa tem por objeto a análise da gestão compartilhada entre diferentes nações na proteção do meio ambiente Para tanto, como objetivo central verifica-se a possibilidade jurídica da gestão regional compartilhada do Aquífero Guarani pelo Brasil Desse modo, discute-se inicialmente a maneira da sociedade contemporânea se relacionar com o meio ambiente e seus reflexos na acumulação de efeitos prejudiciais sobre o meio ambiente, bem como uma análise sobre os efeitos da globalização sobre este Por se tratar de um recurso transfronteiriço, passou a ser pauta de organismos internacionais em escala global a preocupação com a preservação da água e dos recursos hídricos existentes Questiona-se, na sequência, qual a melhor maneira de resposta às questões ambientais surgidas a partir do consumismo, característico da sociedade atual Sedimentar um olhar crítico e unificado nos indivíduos componentes da sociedade de consumo, a fim de que se compreendam parte de um todo maior, o meio ambiente, mostra-se essencial Cabe ressaltar que ainda existem muitos desafios a serem enfrentados no que tange à gestão regional do Aquífero, a começar pela ratificação do Tratado por todos os membros A metodologia adotada neste estudo contou com a revisão bibliográfica da literatura vinculada à temática, bem como a análise documental indireta de tratados internacionais e relatórios institucionais produzidos por instituições públicas e privadas | pt_BR |
| dc.description.abstractother1 | Abstract: Concern over water in the world has become increasingly considering the case-an essential resource to the very existence of life The company, for the most part, used and still use the natural resources without the establishment of safe limits for the maintenance of these resources for future generations The problems arising from that indiscriminate use of natural resources were diverse, including leading wars in various places around the world, which made the countries, international organizations and the general society seek instruments for the preservation of the environment in order to ensure a healthy quality of life Thus arises the concept of sustainable development, with the prevalence of a concerned development of the future generations There are several existing tools for sustainability, and among these instruments is the shared management of natural resources The Agreement on the Guarani Aquifer appears as shared management mechanism between Brazil, Argentina, Paraguay and Uruguay, Mercosur economic bloc components, and as a result of an international treaty that seeks reciprocal concessions and common goals to be achieved Although there is respect for the sovereignty of each country who have an agreement and adhere voluntarily to the treaty, the main purpose is to unify rules of behavior between these, which show if true legal business between the States Parties, enforcing an obligation This research aims at the analysis of shared management between different nations in environmental protection Therefore, the central objective there is the legal possibility of regional shared management of the Guarani Aquifer by Brazil Thus, initially discussed the way of contemporary society to relate to the environment and its effects on the accumulation of harmful effects on the environment, as well as an analysis of the effects of globalization on this Because it is a transboundary resource, has become the agenda of international organizations on a global scale concern for the preservation of water and existing water resources wonders, following what the best way to address environmental issues arising from the consumerism characteristic of today's society Sedimentary a critical and unified look at the component individuals of the consumer society in order to understand that part of a larger whole, the environment, seems essential It notes that there are still many challenges to be faced in relation to the regional management of the aquifer, starting with the ratification of the Treaty by all members The methodology used in this study included a literature review of literature linked to the theme, as well as indirect documentary analysis of international treaties and institutional reports produced by public and private institutions | pt_BR |
