dc.description.abstractA problemática da classificação do contrato de namoro como um negócio jurídico existente, válido, eficaz e decorrente das relações afetivas contemporâneas insere-se nos questionamentos doutrinários e jurisprudenciais acerca da validade e eficácia desse instrumento, considerando as investigações sobre autonomia privada e a teoria geral do negócio jurídico. Busca-se evidenciar os contrapontos às principais críticas, expondo o seu objetivo de declaração da situação fática vigente no momento da celebração pelo casal e ausência da intenção de constituição de família, afastando a presunção de má-fé e elucidando que a produção de efeitos desse contrato depende da manutenção do contexto descrito no documento. Para tanto, pretende-se demonstrar que o contrato de namoro possui os elementos de existência, os requisitos de validade, as características de eficácia de um negócio jurídico e não é previsto ou proibido por lei, logo configura um contrato atípico. O embasamento teórico do presente trabalho está no estudo geral da autonomia, na reflexão da transformação do conceito de família e de namoro, na linha tênue entre o namoro e a união estável, no negócio jurídico, na contratualização familiar e no exercício do direito individual à autodeterminação no Direito de Família por intermédio do contrato de namoro. Utiliza-se o método dedutivo e a modalidade teórica por meio dos procedimentos de revisão de literatura bibliográfica e documental operacionalizados pela exploração inicial, na doutrina brasileira e estrangeira, da autonomia, do negócio jurídico e dos contratos, com posterior aprofundamento, na doutrina e jurisprudência pátria, da temática do contrato de namoro e diferenciação do namoro e da união estável. Assim, analisa-se aqui a possibilidade de caracterização do contrato de namoro como um negócio jurídico que se incumbe de asseverar a segurança jurídica do casal que o celebra, em garantia da autodeterminação nas relações de afeto contemporâneas. Compreende-se que o resultado pretendido contribui com os movimentos de minimização da intervenção estatal e de contratualização do Direito de Família, afetos ao Direito Negocial, e que, em âmbito geral, pode desencadear a diminuição do número de demandas existentes nas varas familiaristas e na redução de custas do erário com situações solucionáveis administrativamente ou extrajudicialmente.
dc.description.abstractother1The problem of classifying the dating contract as an existing, valid, effective legal transaction resulting from effective contemporary relationships is part of the doctrinal and jurisprudential questions about the validity and effectiveness of this instrument, considering the investigations on private autonomy and the general theory of legal business. It seeks to highlight the counterpoints to the main criticisms, exposing its objective of declaring the factual situation in force at the moment of the celebration by the couple and the absence of the intention of forming a family, removing the presumption of bad faith and elucidating that the production of effects of this contract depends on maintaining the context described in the document. Therefore, it is intended to demonstrate that the dating contract has the elements of existence, the validity requirements, the characteristics of effectiveness of a legal transaction and is not foreseen or prohibited by law, thus constituting an atypical contract. The theoretical basis of this work is in the general study of autonomy, in the reflection of the transformation of the concept of family and dating, in the fine line between dating and stable union, in the legal business, in the family contractualization and in the exercise of the individual right to self-determination in Family Law through the dating contract. The deductive method and the theoretical modality are used through the procedures of bibliographical and documental literature review operationalized by the initial exploration, in the Brazilian and foreign doctrine, of autonomy, of the legal business and of the contracts, with posterior deepening, in the doctrine and jurisprudence homeland, the theme of the dating contract and differentiation of dating and stable union. Thus, we analyze here the possibility of characterizing the dating contract as a legal transaction that is responsible for assuring the legal security of the couple that celebrates it, as a guarantee of self-determination in contemporary relationships of affection. It is understood that the intended result contributes to the minimization of state intervention and the contractualization of Family Law, related to Business Law, and that, in general terms, can trigger a decrease in the number of existing demands in the family courts and in the reduction of treasury costs with situations that can be resolved administratively or extrajudicially.
