dc.description.abstractResumo: Este estudo apresenta a análise de um Testamento Vital, documento que define as diretivas antecipadas de vontade de uma pessoa que está enfrentando a terminalidade da vida Nessa perspectiva, esse registro, que tem valor jurídico, reúne o conjunto de desejos, prévia e expressamente manifestados sobre cuidados e tratamentos, aos quais o paciente deseja, ou não, se submeter, no momento em que estiver incapacitado de expressar, livre e autonomamente, sua vontade A Análise de Discurso de linha francesa, perspectiva teórico-metodológica utilizada nesta pesquisa, trata dos processos constitutivos da significação na linguagem, considerando os modos de produção e a emergência dos sentidos Desse modo, nosso trabalho procura mostrar como é produzida a significação na língua, a partir da compreensão de como os sentidos se constroem no e pelo processo discursivo, considerando as condições de produção do discurso, assim como as formações discursiva e ideológica, na busca de compreender o processo de significação na linguagem O corpus de análise é formado pelo testamento vital, o qual foi elaborado pela médica Ana Claudia Quintana Arantes, e, também, por elementos externos – artigos e entrevistas colocados no Anexo – que alicerçam a construção desta pesquisa Observando como o objeto se estabelece discursivamente, nosso objetivo delineia-se, então, por meio da constituição de um recorte teórico, analítico e interpretativo, por meio do qual a materialidade do testamento vital se explicite e revele, também, os modos de constituição da subjetividade nessa materialidade Com o embasamento teórico-prático fornecido pela Análise de Discurso, podemos observar como essa subjetividade se constitui e de que forma permite compreender os discursos existentes no corpus investigado Realizamos interdisciplinaridade com o Direito, apoiados na premissa de que o testamento vital, mesmo sendo um documento jurídico e técnico, está atravessado por outros discursos (além do jurídico, o humano, o religioso, o médico, o familiar) Desse modo, comprovamos que se o profissional do Direito possuir conhecimento em Análise de Discurso, a interpretação do documento será mais justa e consoante à vontade do paciente Para tanto, utilizamos o método científico materialista, baseado nos postulados de Michel Pêcheux A presente tese está dividida em três partes: na primeira, apresentamos o estudo do testamento vital; na segunda, o suporte teórico da Análise de Discurso e na terceira, a análise do corpus, momento em que observamos que o discurso desvela a subjetividade, formando um feixe de discursos Concluímos, portanto, que o conhecimento em Análise de Discurso contribui de maneira significativa para a compreensão do funcionamento da linguagem, sendo uma ferramenta valorosa, especialmente, para os atuantes na área jurídicapt_BR
dc.description.abstractother1Abstract: This study presents the analysis of a living will, a document that defines the advance directives of will of a person who is facing the terminal illness of life In this perspective, this record, which has legal value, gathers the set of desires, previously and expressly manifested on care and treatment to which the patient wants or not to submit, at the time it is unable to express freely and autonomously , your will The French Discourse Analysis, theoretical and methodological approach used in this study, is the constituent processes of meaning in language, considering the modes of production and the emergence of the senses Thus, our work seeks to show how meaning is produced in the language, from the understanding of how the senses are built in and the discursive process, considering the speech production conditions, as well as the discursive and ideological formations in search understand the process of meaning in language The analysis corpus is formed by the living will, which was prepared by the doctor Ana Claudia Quintana Arantes, and also by external elements - articles and interviews placed in Annex - that underpin the construction of this research Observing how the object is established discursively, our goal delineates is then through the establishment of a theoretical, analytical and interpretive cut, through which the materiality of living will be made explicit and reveals also the constitution of modes of subjectivity that materiality With the theoretical and practical foundation provided by Discourse Analysis, we can see how this subjectivity is constituted and how it allows us to understand the existing discourses in the investigated corpus We conducted interdisciplinary with the law, supported the premise that the living will, even though it is a legal and technical document, is crossed by other discourses (beyond the legal, human, religious, medical, family) Thus, we proved that the professional law have knowledge of discourse analysis, interpretation of the document will be fair and according to the patient's will Therefore, we use the materialist scientific method, based on the postulates of Pêcheux This thesis is divided into three parts: first, we present the study of living will; in the second, the theoretical support of Discourse Analysis and third, the analysis of the corpus, when we observe that the speech reveals subjectivity, forming a bundle of speeches We therefore conclude that knowledge in discourse analysis contributes significantly to the understanding of the functioning of language, being a valuable tool, especially for those working in the legal fieldpt_BR
