dc.description.abstractResumo: A memória humana é um conceito complexo responsável por conectar a sociedade com os conceitos de Direitos Humanos Todo o ordenamento jurídico de qualquer nação deveria resguardar esses direitos fundamentais, e a memória teria o poder de impedir que houvesse uma distopia de tais direitos Entretanto, esta não é a realidade atual Nota-se uma dificuldade em construir-se uma memória universal dos direitos fundamentais e uma falta de legislação clara a sobre a memória, o que causa a distorção dos conceitos de memória e de direitos humanos Este processos está ligado à falha no processo informacional de transmissão da memória, que sofre interferência e acaba não sendo nem transmitida, nem absorvida de forma adequada Por isso, realizou-se uma pesquisa interdisciplinar que envolveu os temas da memória, do Direito e da Ciência da Informação, visando identificar os problemas informacionais que interferem na formação da memória dos Direitos Humanos A presente pesquisa utilizou o método indutivo e fontes bibliográficas secundárias, sendo também uma pesquisa exploratória que analisa os dados de maneira qualitativa O objetivo geral foi descobrir quais são os pontos em comum entre a memória e os direitos humanos, analisando os problemas informacionais no processo de transmissão da memória e se existe uma memória de tais direitos Os objetivos específicos foram definir o que são direitos humanos e em qual legislação eles se apoiam no mundo e no Brasil, apresentar os tipos de memória e se cada memória pode ser vista no universo dos Direitos Humanos, comprovar se existe um direito à memória e se este é um direito humano por meio da legislação internacional e brasileira, e demonstrar a importância do processo informacional na transmissão da memória Após a exposição bibliográfica baseada nos três eixos da pesquisa, quais sejam dos Direitos Humanos, da memória e dos pontos em comum entre estes dois temas, os resultados encontrados confirmam a existência de um direito à memória que pode se enquadrar no rol dos direitos humanos, bem como foi possível visualizar como cada memória tem correspondência em questões desses direitos Os resultados também esclareceram que o processo informacional na construção de memória dos Direitos Humanos está relacionado com a memória social, que é a responsável pela formação da memória de tais direitos Deste modo, foi possível concluir que o direito a memória é garantido por meio de leis nacionais e internacionais, sendo o direito de preservar a memória individual um direito humano de primeira geração, o direito de identificar-se com o patrimônio histórico-cultural e o direito à verdade em casos de ofensas aos direitos humanos um direito humano de segunda geração, e a manutenção do patrimônio histórico-cultural um direito humano de terceira geração Por meio das descobertas feitas na presente pesquisa espera-se auxiliar na prevenção da distopia sobre tais direitos, que são de importância basilar para a manutenção da vida em sociedade e da dignidade da pessoa humanapt_BR
dc.description.abstractother1Abstract: Human memory is a complex concept that is responsible for connecting society with the concepts of Human Rights Every legal system of any nation should safeguard these fundamental rights, and memory would have the power to prevent a dystopia of such rights However, this is not the current reality It is noticed a difficulty in building a universal memory of fundamental rights and a lack of clear legislation about memory, which causes the distortion of the concepts of memory and human rights This process is linked to the failure off the informational process of memory transmission, which suffers interference and ends up neither being transmitted nor adequately absorbed Therefore, an interdisciplinary research was carried out that involved the themes memory, Law and Information Science, in order to identify the informational problems that interfere in the formation of the memory of the Human Rights The present research used the inductive method and secondary bibliographic sources, being also an exploratory research that analyzes the data in a qualitative way The general objective was to discover the intersection between memory and human rights, analyzing informational problems in the process of memory transmission and whether there is a memory of such rights The specific objectives was to define what human rights are and in what legislation they are based in the world and in Brazil, present the types of memory and if each memory can be seen in the universe of Human Rights, verify if there is a right to memory and this is a human right through international and Brazilian legislation, and demonstrate the importance of the informational process in transmitting memory After the bibliographic exposition based on the three axes of the research, namely Human Rights, memory and common points between these two themes, the results found confirm the existence of a right to memory that can fit the role of human rights, and it was possible to visualize how each memory has correspondence in questions of these rights The results also clarified that the informational process in the construction of human rights memory is related to social memory, which is responsible for the formation of the memory of such rights Thereby, it was possible to conclude that the right to memory is guaranteed by national and international laws, being the right to preserve individual memory a human right of first generation, the right to identify itself with historical and cultural heritage and right to the truth in cases of human rights offenses a second generation human right, and the maintenance of historical-cultural heritage a third generation human right Through the discoveries made in the present research it is hoped to assist in the prevention of dystopia about such rights, which are of fundamental importance for the maintenance of life in society and the dignity of the human personpt_BR
