| dc.description.abstractother1 | Objective good faith occupies a central position in Brazilian contract law, but the legal consequences of its violation are not always identified with precision, which leads to inconsistencies among categories belonging to different planes of the legal transaction. Against this background, this research aims to examine the extent to which a violation of objective good faith may affect contractual validity, in light of the theory of the planes of the legal transaction and the case law of the Brazilian Superior Court of Justice. The hypothetical-deductive method was adopted, combining bibliographic and documentary research on objective good faith, contemporary contract theory, and the legal framework of invalidity with a case law survey conducted in the database of judgments of the Superior Court of Justice. Six search strategies based on the expression “objective good faith” were applied to decisions issued between January 2016 and August 2026 by the Second Section and the Third and Fourth Panels, resulting in a corpus of seventy-eight cases, from which representative decisions were selected for in-depth analysis. The initial hypothesis was that objective good faith would exert significant and relatively autonomous force on the plane of validity, such that its violation could, in itself, ground the invalidation of the legal transaction. The results indicate that, within the corpus examined, objective good faith was not employed independently as a ground for nullity or voidability; that, where an invalidating consequence was imposed, the general clause operated in conjunction with a specific legal provision, particularly Articles 46, 51(IV), 53, and 54(4) of the Brazilian Consumer Protection Code and provisions of the Brazilian Civil Code governing defects in legal transactions; and that most applications occurred outside the plane of validity, affecting the exercise of legal positions, the effectiveness of the transaction, and civil liability. A preservative function was also identified, whereby objective good faith limits the invocation of invalidity itself in order to protect legitimate expectations. The initial hypothesis was not confirmed. The research concludes that a violation of objective good faith may affect contractual validity in three legally distinct ways—direct, mediated, and preservative—all of which depend on a specific legal basis. Therefore, the general clause does not constitute an autonomous requirement of validity or an independent ground for invalidity | |
